This Legal Notice regulates the conditions of use and browsing of the Web Platform https://www.ilunionhotels.com/ ("the Platform").
Access, browsing and use of the Platform implies being a user ("the user") and, therefore, the user’s express and unreserved acceptance of all the terms and conditions contained in this Legal Notice, which is why we recommend reading it carefully. So, if you do not agree with it or with the privacy and cookies policy to which it is subject, simply do not to accept it using the means provided for that purpose, which will prevent use of the Platform, services and features available on it.

1. GENERAL INFORMATION.

In compliance with the provisions of Act 34/2002, of 11 July, on information society services and electronic commerce, we hereby inform you that the owner of the Platform is ILUNION HOTELS, S.A. 2. WEB PLATFORM: USE, PURPOSE AND APPLICABLE LEGAL SYSTEM.

The Platform is an additional support and communication mechanism that ILUNION HOTELS makes available to users. Therefore, the main features of the Platform will be to bring the Ilunion Hotels chain and all the services it offers closer to its customers.

As far as the Platform is concerned, it is also subject to Spanish legislation, specifically Act 34/2002, of 11 July, on information society services and electronic commerce. As far as personal data processing of personal data, it is subject to Spanish data protection regulations. For more information you can consult our privacy and cookies policy.

3. ACCEPTANCE OF THE CONDITIONS OF USE.

Access to all the features available on this Platform implies the acceptance of each and every one of these conditions, as well as any other that may be established, modified and/or extended due to present or future Service needs. ILUNION HOTELS shall be authorised to modify the content of these conditions at any time, as well as the services and features available on the Platform, understanding that the publication of such changes and modifications through this medium shall be sufficient, without prejudice to the user's option to accept such modification or not. Non-acceptance may prevent the use of the Platform and all or some of the features available on it.

4. CONDITIONS OF ACCESS AND USE.

The user undertakes to make appropriate and lawful use of the Platform, as well as the content, products and services available from it, in accordance with legislation applicable at all times, these conditions, morality and generally accepted good customs and public order.

In general, access to the different features on the Platform will depend on the profile of the user in question, who must sign up and register by means of a system of passwords that will be assigned to them and which they may modify at any time, taking responsibility for their custody and being strictly forbidden to transfer them to unauthorised third parties.

Therefore, the user undertakes to adopt the necessary security measures to maintain the confidentiality of the access and verification systems or codes established in relation to the Platform, and ILUNION HOTELS shall be released from any liability for negligence, carelessness or improper use by the user or any third party in this area.

Furthermore, the Platform user undertakes to:

- Guarantee the authenticity, veracity, timeliness and accuracy of all data communicated through the Platform. The user is solely liable if this is not the case.

- Use the Platform exclusively for the purposes and features provided for this purpose by ILUNION HOTELS. The user is prohibited from using the Platform for any other purpose or means.

- Make legal and legitimate use of the Platform, avoiding unauthorised, fraudulent, illegal or illegitimate use of it and/or of the contents and information made available on it, avoiding infringing this Legal Notice and applicable regulations, and avoiding damaging the legitimate rights and interests of ILUNION HOTELS or of any other third party that may be affected as a consequence of such action.

- Not to cause damage to the physical or logical systems of the Platform, its suppliers or third parties, or attempt to breach the security or authentication measures of the Platform, carry out any action that causes a disproportionate or unnecessary saturation in the infrastructure or communications environment related to the Platform and the Service, attacking it in any way. ILUNION HOTELS may adopt any preventive or corrective measures necessary to protect its interests in order to ensure the correct functioning of the Platform, the Service and its specific features.

- Not introduce or disseminate computer viruses or any other physical or logical systems that may cause damage, such as viruses, malicious code or other harmful programs or files.

- Not attempt to access, use and/or manipulate the data of ILUNION HOTELS, or under its responsibility, or of third party suppliers and other users;

- In particular, by way of example only and without limitation, the user undertakes not to transmit, disseminate or make available to third parties any information, data, content or messages that may infringe the rights of ILUNION HOTELS or third parties.

- Access without authorisation or interact with a false identity, impersonating or not the identity of third parties or using a profile or performing any other action that may cause confusion or mislead as to the correct identification of the user in question.

5. INDUSTRIAL AND INTELLECTUAL PROPERTY.

The user acknowledges and accepts that all industrial and intellectual property rights over the contents and/or any other ILUNION HOTELS elements on the Platform (including but not limited to, trademarks, logos, trade names, texts, images, graphics, designs, sounds, databases, software, presentation, audio and video, if introduced), are the exclusive property of ILUNION HOTELS or of third parties who have specifically authorised ILUNION HOTELS for this purpose.

Under no circumstances does accessing or browsing the Platform imply any kind of waiver, assignment, licence or total or partial transfer of said rights, unless expressly established otherwise in writing.

All intellectual and industrial property rights over the contents and/or services of the Platform are reserved and, in particular, all or part of the contents included therein for public or commercial purposes may not be modified, copied, reproduced, publicly communicated, transformed or distributed by any means and in any form without the prior, express and written authorisation of their respective owners.

Users who violate these limitations and prohibitions acknowledge that they assume exclusive liability in this respect, leaving ILUNION HOTELS or any other third party that may be affected as a result of the user's actions unharmed.

6. DISCLAIMER AND LIABILITY.

ILUNION HOTELS does not guarantee the availability and continuity of Platform operation. Furthermore, under no circumstances shall it be liable for any damages that may arise from:

a) Interruption in Platform operation or computer failures, breakdowns, disconnections, delays or blocks caused by deficiencies or overloads in the systems or mechanisms that allow its operation;

b) Unsuitability of the Platform for the specific needs of users and;

c) Other damage that may be caused by third parties through unauthorised interference beyond the control of ILUNION HOTELS.

ILUNION HOTELS does not guarantee the absence of viruses or other elements in the Platform introduced by third parties unrelated to ILUNION HOTELS that may cause alterations in the physical or logical systems of the users or in the documents, files and archives stored in their systems.

ILUNION HOTELS shall adopt various measures to protect the Platform and its contents against computer attacks by third parties. However, it does not guarantee that unauthorised third parties will not have access to the type of use of the Platform by the user or the conditions, characteristics and circumstances under which such use is made. Consequently, it shall in no case be liable for any damages that may arise from such unauthorised access.

ILUNION HOTELS reserves the right to suspend, without prior notice, access to users who, in its opinion, do not comply with the rules of use of the Platform and to take the appropriate legal action. This will not give rise to any right to compensation in favour of the user who may be affected by this.

ILUNION HOTELS shall not be liable under any circumstances for how users and/or third parties use the Platform, nor for any damages that may derive from such use.

ILUNION HOTELS excludes any liability for damages of any kind that may be due to the use of services and content by users, or due to the lack of information, accuracy or lack of truthfulness of the information provided by them within the framework of the Platform and the Service. In particular, although not exclusively, for damages of any kind that may be due to a user impersonating a third party in any kind of communication or action carried out through the Platform.

7. JURISDICTION AND APPLICABLE LAW.

Any dispute in relation to this Legal Notice shall be submitted to Spanish jurisdiction. The parties expressly agree to submit to the jurisdiction of the court of the consumer/user's residence, unless applicable regulations establish the jurisdiction of other courts for these purposes.

8. MODIFICATION OF LEGAL NOTICE.

ILUNION HOTELS reserves the right to modify this Legal Notice in order to adapt it to applicable future legislative, doctrinal or case law developments, or for technical, operational, commercial, corporate and business reasons, informing users beforehand and reasonably of the changes whenever possible. In any case, each time you access this Platform you should read this Legal Notice in detail.
